Is it possible you have automatic photo upload switched on for any of the following?
Google+
Dropbox
If so then this is your issue, as they are technically not on your phone but in the "cloud".

Hi,
I dont own the phone but from what ive read before.
Usually a long touch on the thunbnail of the picture you want deleted will bring up a trashcan icon, and you can tap that to delete.
I'm not sure if this applies to your model of phone.
Go to Settings > Application manager > All tab > Gallery > Clear Data
From the user manual. Page 84.
Deleting images
Use one of the following methods:
• In a folder, tap → Select item, select images by ticking, and then tap .
• When viewing an image, tap .
