No. As bandofbrothers has said, you can buy a replacement phone. It can be any phone. Doesn't have to be an iPhone if you don't want to spend a lot of money. O2 will give you a new sim. If you don't take a new sim and put it in a different phone, then yes, you will be paying on a new 2 year contract for nothing.

If you sync to iTunes and or iCloud your info will be there although pictures stay in iCloud for a limited time. If you opt for a non iPhone then iTunes won't put saved data into another mobile.

It's not 02's fault your iPhone was stolen and it was your choice not to have insurance !

They supplied the hardware and pay monthly tariff which you accepted so they will expect you to keep to the contract.

I understand what you're saying, and I'm sorry you have had your phone stolen, but without insurance, there's nothing anyone would be able to do. You can buy a very basic, inexpensive phone on Amazon or eBay. It won't do everything you would like, but at least you would have a phone for calls and texts.

The retail value of an iPhone 5 16gb is just over £500 ,so you cannot expect a business just to issue out another unit because of your loss ,without insurance.

I hope you sort yourself out a replacement and recover you let treasured pictures and video.

You can pick up a cheap android or Windows phone for under £100 of you want to use a smartphone or a simple phone for £20 or less so you can keep your contract.
You would have had to pay an excess even if you had insurance which IIRC for an iPhone is £75 which is nearly the cost of a cheap smartphone.
