      <description>When I took out my contract in September 2010 I was sold a £5 per month bolt which gave me unlimited data downloads. In October/November O2 then changed unlimited to 500mb per month. Has anyone else had this problem and if so what was the outcome. When I queried it with O2 they said unlimited only applies to contracts taken out before 24th June 2010,but nobody told me that when I signed up!!!</description>

      <description>I do not dispute it was probably in the T&amp;amp;C's. My beef is I took the contract out over the phone and@ no point was I advised that this was a promotional offer expiring within a month of taking out the contract and feel I was mis-led!</description>

      <description>But the T&amp;amp;C's are then posted out to you and you have 14 days to check them over and reject the deal if there's something in there you don't want to accept. After 14 days, if you haven't informed o2 that you don't want these terms, you've accepted them. You cant expect to turn round 5 months later and say 'oh, hang on a minute.....'&lt;BR /&gt;Calls are recorded and can be checked if the seller has said something wrong, but I doubt they will be kept for five whole months.&lt;BR /&gt;There is no unlimited data on o2 at all anymore, so even if the deal was at fault, it cant be added back on.</description>

      <description>While I agree I should have read the T&amp;amp;C's when I took delivery of tbe phone I stil maintain tbat at no point in making the contract verbally was I advised that the unlimited data was a limited promotion. I am fully aware that I should have checked the contract. I accept that I should have checked the contract, but still strongly feel that the fact that itwas apromotion should have been made clear at the point of sale, Carphone Warehouse!</description>

      <description>Yeah it's annoying but... Well it is what it is and 97% of smartphone users on O2 use less than 500MB.&lt;BR /&gt;Make sure you read the terms and conditions of a contract before blindly agreeing to them...       <description>I think we are at cross purposes here, I specifically said to the sales person that I download a lot of music &amp;amp; music videos. I agree they cannot cover all the T&amp;amp;C's over the phone, but surely if something is a promotion most companies would be promoting that, furthermore I do not recall seeing promotion mentioned anywhere in the T&amp;amp;C's.</description>

      <description>your exact t&amp;amp;c would have stated there is a data limit and not unlimited the unlimited promotion had its own additional t&amp;amp;c. &lt;BR /&gt;ALL traiffs after 24th june had the data caps no unlimited was available as a bolton at any o2 outlet or CPW as you now post only the free promotional offer which I already posted the T&amp;amp;C&lt;BR /&gt;I hope the following clears it up&lt;BR /&gt;I quote from the t&amp;amp;c relevant to your date of contract &lt;BLOCKQUOTE&gt;&lt;TABLE border="1"&gt;&lt;TBODY&gt;&lt;TR&gt;&lt;TD&gt;Data Bolt On, Smartphone Bolt On and Blackberry Bolt On Terms for mobile web usage&lt;BR /&gt;The Data Bolt On, Smartphone Bolt On and BlackBerry Bolt On will allow you use of our data network via your mobile phone (internet capable phones only). &lt;U&gt;&lt;B&gt;The relevant Bolt On includes a specified monthly data allowance&lt;/B&gt;&lt;/U&gt;.       <description>I can actually see your point, but the fault surely lies partly with the cpw salesperson for not responding to your trigger about downloading lots, but with yourself for not checking the terms, as you admit, but also for waiting five months to raise it. What would you expect anyone to be able to do after such a long time?&lt;BR /&gt;The data promo was O2's, not cpw's, so it's not that surprising the seller didn't mention it. You don't believe that guff about cpw being independent to find you the best deal do you? The truth is they will sell you whatever pays the biggest bonus that month, it is always up to the buyer to be aware of what they are taking on and ask all the right questions.&lt;BR /&gt;Do you not have wifi available for your downloads? I find that by being connected to wi fi whenever it's available I never get anywhere near 500 mb.&lt;BR /&gt;Have you checked how much data you used when it was unlimited? Was your post prompted by a text warning you were at the limit?</description>

      <description>I have been disputing the point with O2 since October but was flogging a dead horse. I have only just joined the forum as for months I couldn't access (My 02) on my mobile. Unfortunately I do not often have access to Wi-fi as much as I would like to. It is just so frustrating O2 are blaming CPW who are basically saying I should have checked the contract when I got the phone. I always thought the sale of goods act protected you against this sort of thing, but obviously not.</description>

If any mis-selling was done it was by the vendor.       <description>I accept what you are saying, however when I approached Cpw they said that as I pay O2 direct and not via CPW there is nothong they can do. To be honest I am just really fed up witb the whe thing as everyone is blaming everyone else I just don't know who to believe or turn to. In answer to an eatlier reply I was using approx 2.5gb per month.</description>

      <description>well I have posted the proof.&lt;BR /&gt;Your gripe is with the sales person at cpw.&lt;BR /&gt;Have you complained officially to the correct department at cpw?&lt;BR /&gt;You had 14 days to check the t&amp;amp;c and get out of the contract.&lt;BR /&gt;I would advise you to complain to cpw via there complaints procedures then use the regulator as you believe you have been missold the contract despite you saying you needed a high data package. But I do not think you will get very far.&lt;BR /&gt;You could pay the £10 a month for the extra 1Gb data bolton giving you 1.5GB of data a month. and move up the the tariff with 1gb included and add the bolton to give you 2gb&lt;BR /&gt;The reason O2 had to stop the unlimited was due to high users like yourself crippling the local 3g network preventing others from using the mobile data network.</description>
