It depends when you bought the phone and whether you purchased it direct from O2 or through a 3rd party like Carphone Warehouse.

I believe all phones purchased through Carphone Warehouse are sold unlocked. And O2 are now selling phones unlocked too.

You're best trying another network's sim in your phone to see if it's unlocked. If its locked to O2, follow this link to unlock:
