O2 in breach of contract

Hi, I ordered a 17 pro max in September via the switch up. It was never delivered by DHL and was returned to o2. Since 8th of October o2 have been charging me for a phone I’ve never received and I believe this is in breach of the consumer credit act and o2 don’t seem don’t bothered to help me. Anyone one else had the same issue?

Been in contact with them on a near daily basis with no help.
