Be advised if you have a contract and wish to leave, you must pay off the contract in full (or handset if on Refresh)

If you go through the proper complaints process they might agree to let you leave without paying off your contract but if you are on refresh you can just pay off your phone and walk away anyway.

If they do agree to let you leave now with no penalty at all, you would have to return the handset. Bear in mind that you may already have paid a substantial amount for it but it still belongs to the hire purchase company until fully paid off. That would be your best solution as @MI5 says.
