if i get an up grade can i use the new phone with a different network or is it locked to o2

Locked unfortunately and at the moment will only be unlocked when the handset part of a tariff is paid in full.

The only way you can get an unlocked iPhone is if you buy it directly from Apple...

Three and giffgaff don't lock their phones, but the most sensible option is to get the phone on the network you want to use it on, surely?

I would still recommend checking this with them though if you are considering an iPhone as all iPhones sold by all networks are unlocked until the first SIM is inserted, at this stage they become locked to that SIMs network (with the exception being if you have purchased from Apple directly), so even if 3's iPhones are unlocked, the moment you insert a networks SIM it is locked.
