Presuming the iphone is still under warranty, book a Genius appointment at your nearest Apple store. They will replace a faulty unit immediately.

Having major problems iPhone 4s not accepting calls and ear piece not working, spoke to an advisor last week online but can't find link already had new sim but not helped any ideas paying for a phone that doesn't do work!
I agree with jonsie, book a Genius Bar appointment at your nearest Apple Store. When I had problems with my 4S, luckily I was going to the Trafford Centre (which has a Apple Store). They asked a few questions about the problem I was having, he done a test and said he would replace the 4S. All in all I was in and out in around 10-15 minutes. If I had not been going to the Trafford Centre, the nearest Apple Store to me would involve a 180 mile round trip .
Since then I had a problem with the first two iPad 3's I received and had to get them replaced, but this time I had to deal with Apple Care over the telephone, but again the replacement process was easy. I find Apple's Store or Apple Care to give First Class customer service and you should get your iPhone replaced with no problems.
Just remember to take a backup of your iPhone before going to the Apple Store, then when you get your new iPhone, you can just restore it off of the backup. This saves you setting your new iPhone up as new, has there isn't always the need to do that.
